1) Scope

1.1 These General Terms and Conditions of Isabel Koller, trading as “Ringel Days by Isabel Koller” (hereinafter referred to as the “Seller”), apply to all contracts concluded between a consumer or entrepreneur (hereinafter referred to as the “Customer”) and the Seller regarding the goods and/or services presented by the Seller in its online shop. The inclusion of the Customer’s own terms and conditions is hereby rejected unless otherwise agreed.

1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who enters into a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity. An entrepreneur within the meaning of these General Terms and Conditions is any natural or legal person or partnership with legal capacity who, when entering into a legal transaction, acts in the course of their independent professional or commercial activity.

1.3 These General Terms and Conditions shall apply accordingly to contracts for the provision of vouchers, unless expressly provided otherwise.

2) Conclusion of the Contract

2.1 The product descriptions contained in the Seller’s online shop do not constitute binding offers on the part of the Seller, but are intended to enable the Customer to submit a binding offer.

2.2 The Customer may submit the offer via the online order form integrated into the Seller’s online shop. After entering their personal data, the Customer submits a legally binding contractual offer regarding the goods and/or services contained in the shopping cart by clicking the button that completes the ordering process.

2.3 The Seller may accept the Customer’s offer within five days,

  • by sending the Customer a written order confirmation or an order confirmation in text form (fax or email), whereby receipt of the order confirmation by the Customer is decisive, or

  • by delivering the ordered goods to the Customer, whereby receipt of the goods by the Customer is decisive, or

  • by requesting payment from the Customer after the Customer has placed the order.

If several of the aforementioned alternatives apply, the contract shall be concluded at the time when one of the aforementioned alternatives occurs first. If the Seller does not accept the Customer’s offer within the aforementioned period, this shall be deemed a rejection of the offer, with the consequence that the Customer is no longer bound by their declaration of intent.

2.4 The period for acceptance of the offer begins on the day following submission of the offer by the Customer and ends at the expiry of the fifth day following submission of the offer.

2.5 When an offer is submitted via the Seller’s online order form, the contract text is stored by the Seller and sent to the Customer in text form (e.g. email, fax or letter) together with these General Terms and Conditions after the Customer has submitted their order.

In addition, the contract text is archived on the Seller’s website and can be accessed by the Customer free of charge via their password-protected customer account by entering the corresponding login details, provided that the Customer created a customer account in the Seller’s online shop before submitting the order.

2.6 Before submitting a binding order via the Seller’s online order form, the Customer may continuously correct their entries using the usual keyboard and mouse functions. In addition, all entries are displayed once again in a confirmation window before the binding order is submitted and may also be corrected there using the usual keyboard and mouse functions.

2.7 The German language is available for the conclusion of the contract.

2.8 Order processing generally takes place automatically by email. The Customer must ensure that the email address provided for order processing is correct so that emails sent by the Seller can be received at this address.

3) Right of Withdrawal

Consumers generally have a right of withdrawal. Further information regarding the right of withdrawal can be found in the Seller’s cancellation policy.

4) Prices and Payment Terms

4.1 The prices stated by the Seller are total prices. VAT is not shown because the Seller is subject to the small business regulation. Any additional delivery and shipping costs that may apply are stated separately in the respective product description.

4.2 The Customer has various payment options available, which are specified in the Seller’s online shop.

4.3 If advance payment has been agreed, payment is due immediately after conclusion of the contract.

4.4 If the payment method “PayPal” is selected, payment is processed by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, subject to the PayPal Terms of Use, available at:

https://www.paypal.com/ch/webapps/mpp/ua/useragreement-full?locale.x=de_CH

This requires, among other things, that the Customer opens a PayPal account or already has such an account.

4.5 If a payment method offered via the “Shopify Payments” payment service is selected, payment is processed by Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland (“Shopify”).

The individual payment methods offered via Shopify Payments are communicated to the Customer in the Seller’s online shop.

For payment processing, Shopify may use additional payment service providers to which special payment terms may apply. Where applicable, the Customer will be informed separately of such terms.

Further information about “Shopify Payments” is available online at:

5) Delivery and Shipping Conditions

5.1 Goods are generally delivered by shipment to the delivery address specified by the Customer. When processing the transaction, the delivery address specified during the Seller’s order process is decisive.

Notwithstanding the foregoing, if PayPal is selected as the payment method, the delivery address stored by the Customer with PayPal at the time of payment shall be decisive.

5.2 If the transport company returns the shipped goods to the Seller because delivery to the Customer was not possible, the Customer shall bear the costs of the unsuccessful shipment.

5.3 As a general rule, the risk of accidental loss and accidental deterioration of the goods sold passes to the Customer when the goods are dispatched or handed over to the commissioned carrier.

5.4 In the case of collection by the Customer, the Seller will first inform the Customer by email that the goods ordered are ready for collection. After receiving this email, the Customer may collect the goods following consultation with the Seller. No shipping costs will be charged in this case.

6) Liability for Defects

The statutory provisions regarding liability for defects shall apply.

7) Redemption of Gift Vouchers

7.1 Vouchers that can be purchased via the Seller’s online shop (hereinafter referred to as “Gift Vouchers”) may only be redeemed in the Seller’s online shop, unless otherwise stated on the voucher.

7.2 Gift Vouchers may only be redeemed before completion of the ordering process. Subsequent offsetting is not possible.

7.3 Gift Vouchers may only be used for the purchase of goods and not for the purchase of additional Gift Vouchers.

7.4 If the value of the Gift Voucher is insufficient to cover the order, one of the other payment methods offered by the Seller may be selected to pay the outstanding amount.

7.5 The balance of a Gift Voucher will neither be paid out in cash nor bear interest.

7.6 The Gift Voucher is intended only for use by the person named on it. Transfer of the Gift Voucher to third parties is excluded. The Seller is entitled, but not obliged, to verify the substantive entitlement of the respective voucher holder.

8) Applicable Law, Jurisdiction

8.1 If the Customer acts as a consumer, all legal relationships between the parties shall be governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), and the exclusive place of jurisdiction for all disputes arising from this contract shall be the Customer’s place of residence.

8.2 If the Customer acts as an entrepreneur, the exclusive place of jurisdiction for all disputes arising from this contract shall be the Seller’s place of residence or registered office.
